Shuk Privacy Policy

Shuk Group and its related entities (referred to as “we”, “us” or “our”) are committed to protecting your privacy and handling your Personal Information in accordance with the Australian Privacy Principles. This Privacy Policy explains how we collect, use, disclose, store and protect your Personal Information. It applies to information provided through our restaurants, our head office, our website, our ordering platforms and any other means of interaction with us.

Shuk Loyalty Program Terms and Conditions

1. Introduction

1.1. The Shuk Loyalty Program (referred to as the Program) is operated by Shuk Pty Ltd ABN 67 130 583 390 (referred to as we, us, our, or the Company).
1.2. These Terms and Conditions govern the Program and the relationship between the Company and Program members.
1.3. By registering for the Program, you agree to these Terms and Conditions, which may be amended from time to time.
1.4. You also consent to our collection, use, and disclosure of your personal information in accordance with our Privacy Policy (insert link). You also acknowledge that we may disclose your personal information to our supplier Tabit Technologies Pty Ltd (Tabit) and you consent to Tabit handling your personal information in accordance with the Tabit Privacy Policy (insert link).
1.5. Membership is intended for private individuals for personal or family use only. It is not intended for businesses, corporations, institutions or similar entities.
1.6. The Company may engage third parties to provide Program services. These parties act on behalf of the Company, and the Company remains responsible for their acts or omissions.

2. Membership Eligibility and Registration

2.1. Membership is available to individuals aged 18 years or older with a valid Australian address.
2.2. To become a member, you must complete the registration process and provide personal information such as your name, date of birth and contact details.
2.3. Membership is free, personal and non transferable.
2.4. You are responsible for ensuring your membership details remain accurate.
2.5. We may refuse membership at our discretion.
2.6. You are responsible for providing accurate information and updating us when your details change. The Company is not responsible for any failure in delivery of communications or benefits caused by incorrect or outdated details.

3. Earning Loyalty Benefits

3.1. Members may receive benefits, rewards or offers when making purchases at Shuk locations.
3.2. The type of benefits available, how they are earned, and how they may be redeemed will be determined by the Company and may change from time to time.
3.3. Benefits may be linked to visit frequency, purchase history, promotional participation, special events or seasonal campaigns.
3.4. To earn benefits, you must identify yourself as a member at the time of purchase by providing your phone number or another approved method.
3.5. Benefits will be applied to your account according to the rules of the specific promotion or offer.
3.6. We may adjust earning rules, eligibility criteria or benefit availability at any time with 30 days notice to members.
3.7. Benefits cannot be earned on cancelled transactions or items excluded by the Company.

4. Redeeming Loyalty Benefits

4.1. Loyalty benefits may include discounts, promotional items, exclusive offers or other rewards.
4.2. Redemption requirements, including minimum purchase amounts or product availability, may vary by promotion.
4.3. To redeem a benefit, you must notify staff at the time of purchase and identify yourself as a member.
4.4. Benefits cannot be exchanged for cash and are not transferable.
4.5. Redemption is subject to availability at the venue where the benefit is being used.
4.6. Once redeemed, benefits cannot be reversed.
4.7. Benefits or promotional items provided as part of the Program may only be redeemed using accepted payment methods.
4.8. Each benefit may be redeemed once unless otherwise stated.

5. Additional Program Benefits

5.1. The Program may offer additional permanent or seasonal benefits as detailed in Appendix A or future promotional communications.
5.2. Members may receive exclusive offers or promotions determined at the Company’s discretion.
5.3. The Company does not guarantee ongoing availability of any specific benefit or type of benefit.

6. Expiry and Cancellation of Benefits

6.1. All benefits provided under the Program will have an expiry date, which will be communicated in the relevant offer.
6.2. Expired benefits cannot be reinstated or redeemed.
6.3. If your membership is terminated, all unused benefits will be forfeited.
6.4. If the Program is discontinued, members will be given at least 90 days notice to redeem outstanding benefits.
6.5. We may suspend or terminate memberships without notice in cases of suspected fraud, misuse or violation of these Terms and Conditions.

7. Communications

7.1. By joining the Program, you consent to receive communications related to your membership, benefits and Program updates.
7.2. You may opt out of direct marketing through:
a. SMS unsubscribe links
b. Email unsubscribe options
c. Contacting us via our website or social media
7.3. Opt out requests may take up to 5 business days to process.
7.4. Even if you opt out of marketing communications, we may still contact you with important information about your membership or changes to the Program.

8. Privacy

8.1. We collect, use and disclose personal information as described in our Privacy Policy (insert link).
8.2. By participating in the Program, you consent to the handling of your personal information in accordance with our Privacy Policy and the Tabit Privacy Policy.

9. Modifications to the Program

9.1. We may modify the Program or these Terms and Conditions at any time.
9.2. Significant changes that may negatively affect members will be communicated with at least 30 days notice.
9.3. If the Program is terminated, members will be given at least 90 days to redeem outstanding benefits.
9.4. Continued participation after changes indicates acceptance.
9.5. Membership may be suspended or terminated without notice in cases of suspected misuse or breach of these Terms and Conditions.

10. Limitation of Liability

10.1. We will use reasonable efforts to operate the Program as described. We are not responsible for failures beyond our control.
10.2. Except as required by law, we are not liable for indirect or consequential losses including loss of revenue, opportunity or any commercial loss.
10.3. Nothing in these Terms limits your rights under the Australian Consumer Law. Where permitted, our liability is limited to resupplying the goods or services or paying the cost of replacement.
